FAQ
 1.       What is the insured deposit?
 
An Insured deposit is a deposit representing every Dinar or foreign currency depositor’s claim against a bank(deriving from a money deposit, a savings deposit, a current account or any other account)which is insured by the Agency in accordance with the existing legal provisions.
 
 2.       Whose deposits are insured?
 
Insured deposits are the deposits of :
  • Natural persons,
  • Entrepreneurs,
  • Small legal entities
  • Medium-sized legal entities.

 

 3.       Which deposits are not insured?
The following deposits are not subject to deposit insurance:
  • Deposits of legal and natural persons connected with the bank, according to the law governing banks;
  • Coded or bearer deposits;
  • Deposits arising from transactions used for money laundering or for funding terrorism;
 
 4.       Which banks are obligated to insure deposits and who pays for this type of insurance?
 
All banks licensed by the National Bank of Serbia are bound to insure deposits and pay insurance premiums at regular intervals.
Only banks (not the depositors) have the obligation to pay deposit insurance premiums.
Guaranteed deposit insurance is free of charge for depositors.
 
 5.       What happens when bankruptcy proceedings are initiated against a bank?
 
The Agency shall inform all depositors through the mass media about the selected payout bank, the date of starting repayments, the manner and the location where the insured amounts will be paid out. Pursuant to applicable regulation, the the repayment of insured deposits shall start within 3 days from the date the National Bank of Serbia rendered the decision on instituting of bankruptcy proceedings over the bank.
 
 6.        Is a request for payment required?
Yes, each depositor must submit a written request to the payout bank. The request should include the following:
1. If the depositor is a natural person:
  • Your personal data (name, surname, date and place of birth, place of residence – street and number, unique personal number),
  • Total amount of deposit claimed and the preferable method of payment (cash/transfer to another account).
 
2. If the depositor is an entrepreneur or small or medium-sized legal entity:
 
  • Data concerning the firm, i.e. legal entity (name, address, ID number, tax identification number),
  • Total amount claimed and the preferable method of payment (cash/transfer to another account)
 
Apart from the written request, claimants should also submit the following supporting documents: attested current account, drawing account and/or foreign currency account contract, savings account contract, attested savings book, decision on inheritance or other legally prescribed documents along with an identification document.
 
 7.       Where can I get the request for payout of insured deposit?
At all paying places of selected payout bank you can get the request for payout of insured deposit.
 
 8.       What is Insured amount?
Insured amount is insured deposit amount up to EUR 50.000 in dinar counter value by the official middle exchange rate, which is valid on a day of rendering decision of National bank of Serbia on revoking bank’s operating license, by the depositor, established after settlement of claims between depositor and a bank.
 
 9.       In which currency are insured amounts paid out?
Insured amount for deposits made in RSD is paid out in RSD and for those made in foreign currency the insured amount is paid out in EUR at the Euro rate of exchange with the given currency on the day the National Bank of Serbia made a decision to instigate bankruptcy proceedings.
 
 10.   What is a net claim?
Net claim is the amount payable to an individual depositor. It is determined following the set-off of depositor’s claim against his total due financial obligations towards the bank. It is calculated applying the following formula:
 
 Total deposits per depositor in the bank
 +  accured interest (untilthe day the bank’s operating licence was revoked)
 -  all due liabilities of the depositor(loans, current account overdraft, etc.)
= depositor’s net claim
 
 11.   What happens if the net claim exceeds the insured amount?
If depositor’s net claim exceeds EUR 50,000 in RSD countervalue, the remaining amount is paid to the depositor in the course of bankruptcy proceedings.
 
Example : The determined amount of net claim is EUR 60,000. In this case, the Agency will pay the depositor EUR 50,000 in the legal timeframe. The depositor may claim the remaining uncollected amount (EUR 10,000) from the bank’s bankruptcy estate.
 
 12.   Is my deposit insured even in the case of bank liquidation?  
Yes. The Law on Bankruptcy and Liquidation of Banks and Insurance Companies (“Official Gazette of the RoS”, Nos. 61/05, 116/08) is harmonized with the Law on Deposit Insurance.

DECISION
on Determination of the Contents of the Template for the Report on Balance of Deposits of Large Legal Entities Submitted to the Agency by Banks
 
 
1.      The contents of the template for the Report on Balance of Deposits of Large Legal Entities – AGOD 01 Form (hereinafter: the Report), submitted to the Agency by banks, enclosed hereto as Attachment 1 and constituting an integral part of this Decision, are hereby determined.
 
2.      The Report referred to in item 1 is a monthly report submitted to the Agency by banks no later than by the 14th day of the current month for the previous month. If the 14th day in a month falls on a holiday, a Saturday or a Sunday, the deadline for the submission of the Report shall be extended to the first following business day. Notwithstanding the foregoing, the final deadline for the submission of the Report for November 2011 shall be 20 December 2011.  
 
3.      Banks shall compile Reports in accordance herewith and submit them to the Agency starting with the Report for November 2011.  
 
4.      Banks shall complete the Report Template in line with the “Instructions for the Completion of the Template for the Report on the Balance of Deposits of Large Legal Entities (AGOD 01 Form) Submitted to the Agency by Banks”, enclosed hereto as Attachment 2 and constituting an integral part of this Decision.
 
5.      At the Agency’s request and in the manner and within the timeframes set by the Agency, banks shall also submit other data which the Agency might require in order to conduct its activities as set forth by the law.
 
6.      The Director of the Agency is hereby authorised to revise the Report Template provided in the Attachment 1 and the “Instructions for the Completion of the Report Template” provided in the Attachment 2 for the purpose of their adaptation to the regulations in force. Revised Report Template provided in the Attachment 1 and revised Instructions for the Completion of the Report Template provided in the Attachment 2 shall be published in “Official Gazette of the Republic of Serbia” and delivered to all banks within 3 days from the revision.
 
7.      The Agency shall submit this Decision to the National Bank of Serbia and all banks operating in the Republic of Serbia within 3 days from its adoption.
 
8.      This Decision shall become effective on the day of its adoption.
 
9.      This Decision shall be published in “Official Gazette of the Republic of Serbia”.

А) GENERAL
 
1. Template АGOD 01 isbycontentandformsinglefor all the banks operating in the Republic of Serbiaand which were granted the operating license by the National Bank of SerbiaIt is written in Serbian language. It contains in its header full business name of the bankand address of its registered seat.
 
2. Template АGOD 01 consists of 9 separate parts:
-          Under no. 1) Report on Levelof Deposits Held by Banksand Other Financial Institutionsfor the month ....... of 20..   – TemplateAGOD 01 BA, hereinafter: TemplateAGOD 01 BA;
-          Under no. 2) Report on Level of DepositsHeld by Insurance Companiesfor the month....... of 20.. – TemplateAGOD 01 ОS, hereinafter: TemplateAGOD 01 ОS;

3.  ThebalancesasatlastcalendardayinthemonthforwhichtheReportismadeandsubmittedtotheAgencyshallbeinsertedintotheTemplateAGOD 01, andareestablishedonthebasisofthebookbalance provided in the monthly report in accordance with the validregulation by the National Bank of Serbiaprescribing the banks’ obligationon the method of collection, processing and submission of information оn balance and structureof the banks’ placements, claimsand obligations (now template USSPO).
 
Theamountofdepositincreasedbytheamountofaccruedinterestrepresenting the bank’s obligation for payout to a depositor in line with agreed terms and conditions is understood to mean the level of deposit as per paragraph 1 of this clause.
 
4. Completion of templates referred to in clause 2, rows 1 to 8 is done in the same way, by inserting into each of them the data for the category of depositors they relate to, namely:
-          Into Template 01 BAdata on deposits of depositors which are banksand other financial institutions,
-          Into templateAGOD 01 ОSdata on deposits of depositorswhich are insurance companies,
-          IntotemplateAGOD 01 LZdataondepositsofdepositorswhicharefinancialleasingproviders, intotemplateAGOD 01 DP data on deposits of depositorswhich are voluntary pension funds,
-          IntotemplateAGOD 01 UFdataondepositsofdepositorswhich are pension funds management companies,
-          IntotemplateAGOD 01 IFdataondepositsofdepositors which are investment fundsand investment fund management companies,
-          Into templateAGOD 01 BDdata on deposits of depositorswhich are the Stock Exchange and brokers,
-          IntotemplateAGOD 01 OLdataondepositsofdepositorswhich, accordingtoprovisionsofthelawregulatingaccounting and audit, represent large legal entities, and do not belong to previously stated categoriesof depositors,

5. Depositors’ depositsreferredtoinclause 4 of this Instruction are understood to mean deposits of residents.
 
6.Thedepositswhich, undercriteriafromtheLawonDepositInsurance („Official Gazette of the Republic of Serbia“, no. 61/05, 116/08 and 91/10), hereinafter: Law, would be exempted from deposit insuranceare deposits:
(1)  of persons connected with a bank, according to the law regulating banks;
(2)  coded or bearer deposits;
(3)  arisen from money launderingor terrorism financing, which is set by law.
7. Instruction for completion of templateAGOD 01 is given on the example oftemplateAGOD 01 OLin the sectionB) TEMPLATE AGOD 01 ОL (for depositors: other large legal entities).
 
TheReportshallbesubmittedtotheAgencyviaprotectednetworkCisco Access Control Server 4.2 for Windowsaccordingtodefinedcommunication parametersby using the special password for communicationbetween a bankand IT sector.
 
B) TEMPLATE AGOD 01 ОL
 
1. TemplateAGOD 01 ОLconsists of 4 data groups on deposits:
-          InthepartIData on level of depositsOtherlargelegalentities(lines 1., 2., 2.1.-2.3.)areprovidedthedataondepositsanddepositorswhich, inlinewithprovisionsofthelawregulatingaccountingandaudit, represent large legal entities, and are not classified into categories of depositors statedfrom 1) to 8) within clause 2 of this Instruction.   
-          InthepartIITotaldepositswhichwouldbedeemedinsuredaccordingtocriteriasetbytheLaw, bycurrencies (3, 3.1-3.13.) are provided the data on level of deposits (total amount of depositsand number of depositorsfor a certain type of currency);
-          Intothepart IIITermstructureofdeposits (4.,4.1.-4.2., 5., 5.1.-5.4., 6., 6.1.-6.4.,7.,) shall beinsertedthedataon deposit balanceof other large legal entitiesaccording to initial maturity;
-          IntothepartIV Depositranking (8.1., 8.2., 9.1., 9.2., 10.1., 10.2., 11.) shall beinsertedthedataoninsuredamountofdepositsper depositor, other large legal entityin a bankup toEUR 50.000, betweenEUR 50.000,00 and 100.000,00 and over EUR 100.000,00.
 
2. Into rowunder 1.shall be inserted the dataon amount and number of total depositsand number of depositors for other large legal entities. The amount of total depositsis given in RSD.
 
3. Intorowunder 2.shall beinsertedthedata (amountinRSDandnumberofdepositsanddepositors) ontotaldepositsof other large legal entities which would be exempted from the deposit insurance system according to criteria set by the Law
 
4. Cumulativedataunder 2.is given in detail in rows 2.1 .- 2.3.by stating datafor each category of deposits which would be exempted from the deposit insurance system according to the Law. Sum of the amountsstated in rows under 2.1.-2.3. is equal to the data under 2.
 
5. Intorowunder 3. shall beinsertedthedataontotaldepositsofotherlargelegalentitieswhichwouldbedeemedinsuredaccordingtotheLaw (amount in RSDand number of deposits and depositors), and represent the marginof data under 1. and 2. (1.-2.).
 
6. Into rows3.1. - 3.13. (partII Total deposits which would be deemed insured according to the Law, given by currencies)shall be inserted the following data:

-          Intorowsunder 3.6.to 3.12.: dataontotaldepositsofotherlargelegalentitiesdepositedinothercurrencies (AUD, CAD, DKK, JPY, KWD, NOKandSEK) foreachcurrencyseparately (numberofrowsdepends on the number of currency typesin which the deposits are held), as well as the number of deposits and depositors to which they relate.A bank shall present those types of currencies in which it hasdeposits of other large legal entities.
-          Into rowunder 3.13.: data on total depositsof other large legal entitiesin other currencies shown in EUR.
 
7. Into rows under4., 4.1.-4.2., 5.,5.1.-5.4., 6.,6.1.- 6.4. (III Term structure)shall be inserted the data on amount in RSD, number of depositsand number of depositors:
-          Into rowunder4. for total amount of sight depositsof other large legal entitiesas a sum of the following lines 4.1. and 4.2.;
-          Into rowunder4.1.for account balancesof sight deposits in RSDof other large legal entities;
-          Into rowunder4.2.for account balancesof sight deposits in foreign currencyof other large legal entities;
-          Intorowunder 5.fortotalamountofshort-termdepositsof other large legal entities as a sum of the following lines 5.1., 5.2., 5.3, and 5.4;
-          Into row under 5.1.for account balancesof short-term RSD depositsof other large legal entities up to 3 months;
-          Into rowunder 5.2.for account balancesof short-term RSD depositsof other large legal entities from 3 to 12 months;
-          Into row under 5.3.for account balancesof short-term deposits (in foreign currency)of other large legal entitiesup to 3 months;
-          Into rowunder 5.4.for account balancesof short-term deposits (in foreign currency)of other large legal entities from 3 to 12 months;
-          Intorowunder 6.fortotalamountoflong-termdepositsof other large legal entities as a sum of the following lines 6.1., 6.2., 6.3 and 6.4.
-          Into rowunder 6.1. foraccountbalancesoflong-term RSDdeposits of other large legal entities without deposits put as a condition for granting a loan;
-          Intorowunder 6.2. foraccountbalancesoflong-term RSDdepositsof other large legal entities put as a condition for granting a loan;
-          Into rowunder 6.3.foraccountbalancesoflong-termdeposits (inforeigncurrency) of other large legal entitieswithout deposits put as a condition for granting a loan;
-          Into rowunder 6.4.for account balancesof long-term deposits (in foreign currency)of large legal entities put as a conditionfor granting a loan;
 
8. Data inserted into row under 7.(IIITerm structure) represent the sum of datagiven under4., 5. and6., is equal to the data under 1.
 
9. Intorows 8.1., 8.2., 9.1, 9.2., 10.1., 10.2. and 11. (IVDepositrating)  shallbeinsertedthedatapresentedinRSD, aswellasthedataon numbers of deposits and depositors. This data will be presented entirely in a mannercurrent for draftingtheReport АGOD 02, according to the following:
-          Rowunder 8.1.,theamountofdepositwhich shall represent insured amount of depositnetperdepositor -  otherlargelegalentity,uptoEUR 50.000,00 and which would be paid out in RSD;
-          Rowunder 8.2.,theamountofdepositwhich shall represent insured amount of depositnetperdepositor -  otherlargelegalentity,uptoEUR 50.000,00 and which would be paid out in EUR;
-          Rowunder 9.1.,theamountofdepositwhich shall represent increase of insured amount of deposit netperdepositor -  otherlargelegalentity,fromEUR 50.000,00 to 100.000,00 and which would be paid out in RSD;
-          Rowunder 9.2.,theamountofdepositwhich shall represent increase of insured amount of depositnetperdepositor -  otherlargelegalentity,fromEUR 50.000,00 to 100.000,00 and which would be paid out in EUR;
-          Rowunder 10.1.,theamountofdepositwhich shall represent increase of insured amount of depositnetperdepositor -  otherlargelegalentity,overEUR 100.000,00 and which would be paid out in RSD;
